CONSERVATION COMMISSION

MEETING DATE: November 10, 2008
Present: Richard Andrus, David Dempsey, Judy Bach, and Christopher Blair
The meeting convened at 6:15p.m.
Levkoff, 26 Eaton Rd – NOI #230-0246, SMA RDA08-02 & SMANOI 08-03 – improve existing walkpath, construct new walkpath and beach area and install a dock with a boardwalk on Lake Garfield and to further develop the site while maintaining the existing single family residential use of the site (D. Dempsey is the project manager)
Nick Anderson of Berkshire Engineering was present to update the Board. A site visit was made by Commission members and it was concluded that trees marked red are not in any jurisdictional area. Trees marked with yellow ribbons are within the Scenic Mountain area (steep slope) as is the existing house slated for demolition. White dotted trees with yellow ribbons are in the 100 foot buffer zone or wetlands of the proposed beach location. The Commission also agreed that a “cleared lawn area” doesn’t currently exist. The Chairperson read aloud a letter dated September 9, 2008 from Berkshire Engineering regarding supplemental information in response to the September 8, 2008 Public Hearing under the WPA. The Conservation Commission issued an approved Order of Conditions for
the NOI #230-0246 under the WPA, a motion was made and seconded to close the public hearing for NOI #230-0246, the motion passed. The Commission issued a positive determination for the SMA RDA08-02. Special conditions which were discussed amongst the commission members will be written at a later date and attached to the issued documents.
Steven’s Lake Homeowner’s Association, NOI 230-0250, to discuss management of the excessive aquatic vegetation and algae in Steven’s Lake by utilizing U.S. EPA registered and state-approved herbicides and algaecides (T. Lovett is the project manager)
A representative from Lycott Engineering came in to discuss the maintenance program which is being refilled for as the existing contract expired in April of this year. NOI # 230-0250 submitted states that Lycott will manage the excessive aquatic vegetation and algae in Steven’s Lake by utilizing U.S. EPA registered and state-approved herbicides and algaecides. This has been going on for several years with some success. The Commission approved the NOI as submitted and an Order of Conditions will be issued.
Schwartz – 66 Art School Rd – NOI continue the pond program maintenance to prevent the establishment of invasive species and to preserve desirable water quality (T. Lovett is the project manager)
The Commission opened the hearing; no one was present so the hearing was continued until the December meeting.
Erlich – 26 Northwest Cove Rd RDA to seasonally install and maintain two docks, one floating and one suspended plus a canopy which will all be removed in the winter months (enforcement order sent previously) (D. Dempsey is the project manager)
This hearing was continued until the December meeting or until DEP comments have been received whichever comes first. The Commission has been in touch with DEP regarding this hearing and has been informed that the applicant didn’t properly advertise their Chapter 91 permit application so the 30 days comments period has not yet begun. Once this has been done the Commission should be notified of the advertisement so they can submit their comments.
For Discussion:
1. Mail was reviewed.
2. Minutes from 10.14.08 were approved as written.
3. Rob Akroyd from Greylock Design out of Lenox came in to discuss a project that will be coming in front of the Commission soon. Rob is hoping to get any suggestions or comments the Commission might have prior to submitting anything. The proposed project is located on Steven’s Lake.
4. Certificates of Compliance were issued for 2 open and completed Order of Conditions located at 19 Point Road. NOI #’s 230-189 & 230-163.
5. The Commission informally discussed the pros and cons of a green building bylaw and whether it would be something they would want to pursue. Chris Blair is going to speak with the Building Commissioner to get his thoughts.
6. The Commission instructed M. Noe to remove the Pearson project from the agenda as the project has been withdrawn.
7. The Commission reviewed the Kelly/Nadler project and instructed M. Noe to remove from the agenda.
8. Chris Blair informed the Commission that DEP is going to be putting several applications and filing documents online for viewing.
